TERMS AND CONDITIONS GaydarU / Gaydar23 is a special promotion providing full and free membership to the Gaydar dating site for users meeting specific requirements. Prizes can also be won for referring people to the promotion. ELIGIBILITY AND HOW TO APPLY [EXCLUDING AU/UK/IE] To benefit from a free membership you must meet the following criteria: 1) You must be resident in one of the following countries: USA, Brazil, Columbia, Mexico, Argentina, Chile, Spain, Italy, The Netherlands, Germany, France, Portugal, South Africa, Japan, Greece. 2) Your age must be over 18 and under 24. This must be substantiated by submission of valid photo ID, submitted according to the instructions provided on site. This can be a copy of your student card, driver’s license, passport or other official documentation that clearly indicates your date of birth. 3) You must have at least one photo of your face in your Gaydar profile – you can set this to public or private. We will use this to confirm your age so it must be easy to identify you and match to your ID (if supplied). We will endeavour to upgrade your account as soon as possible. We may contact you by email to request further documentation if we are not satisfied of your eligibility. You will cease to be eligible for this free membership promotion on the day of your 24th birthday. You will be unable to change your Date of Birth on Gaydar to prolong access to the promotion. All existing members who meet the eligibility criteria will be automatically upgraded to a full membership on commencement of the promotion, and no further action is required. No refunds for previous purchases will be made. TERMINATION AND DISQUALIFICATION We reserve the right to end this promotion at any time, in which case your free upgrade may, at the sole discretion of the Promoter, be revoked. If you are found to have submitted fraudulent proof of age or studentship your account may be suspended. COMPETITION - ENTRY Entry is only open to those eligible for the free membership upgrade according to the criteria listed above. You must be a resident of one of the following countries: United Kingdom, Ireland, Australia, USA, Brazil, Columbia, Mexico, Argentina, Chile, Spain, Italy, Netherlands, Germany, France, Portugal, South Africa, Japan, Greece. You must be aged over 18 years and under 24 years. Employees and their immediate families (including any live-in partner) of the Promoter (see the end of these Terms and Conditions below for details), QSoft Consulting Limited (if different) and/or agencies associated with this competition are ineligible to enter. Any such entries will be invalid. The competition is run on an ongoing basis, with one prize draw each month, in months where the competition is advertised on the site. The opening date for each competition is the 1st of the month and the closing date is the end of the month. In order to enter you must submit your first and last name, email address, gaydar profile name, and refer at least one friend to the promotion by giving their email address. Entry to the competition is via www.gaydaru.com, www.gaydar23.com, www.gaydaru.co.uk or www.gaydar23.co.uk No purchase is necessary COMPETITION – PRIZES The first entries drawn at random from all eligible entries will win the prizes. The number of winners drawn may vary from month to month and will be clearly stated on the website. The winners will be contacted via the contract details they have given after the closing date and time of the competition. If they cannot be contacted or do not respond as specified within 28 days of having been contacted and a message left, then the Promoter reserves the right to offer the Prize to the next correct entrant drawn and thereafter until a winner is found. The prizes offered may change each month and are clearly stated on the website. No cash equivalent or alternative prizes will be given and the prizes are non-transferable. However, the Promoter reserves the right to change the prizes due to circumstances beyond its control or to offer an alternative of similar value. In the event that the winner does not, or is unable to, comply with and meet these Terms and Conditions, the Promoter shall be entitled at its discretion to disqualify the winner, without any further liability to the winner. DATA PROTECTION Information and data ("personal data") which is provided by you as an applicant for this promotion will be used by the Promoter, QSoft Consulting Limited (if different) and their suppliers and contractors in order to administer the promotion. Once verified, documents supplied will be destroyed and only an approval note will be kept on file. Aggregate, non personal data may also be used for the purpose of undertaking market research or in facilitating reviews, developments and improvements to relevant services. Your personal data will only otherwise be used by QSoft Consulting Limited in accordance with its privacy policy. TECHNICAL The promoter is not liable for technical, hardware or software failures of any kind or lost or unavailable network conditions which may limit or prohibit ability to participate in the competition. Applications that are incorrect or incomplete will be void. In the event of any fault, mistake, misunderstanding or dispute concerning the operation of any part of the competition or the operation of the web site, the decision of the Promoter shall be final. The Promoter is not responsible for network, telephone line or communication failures of any kind or for applications that are incomplete or incomprehensible or not received. Such entries will be void. General Terms GaydarU / Gaydar23 is a special promotion provided by QSoft Consulting Ltd ("QSoft") on the Gaydar websites and these Terms and Conditions therefore incorporate the Gaydar Membership Terms and Terms of Use (including, without limitation, the requirements on acceptable use). Suspension, removal or any other end in membership from Gaydar will result in elimination from the promotion. The Promoter and QSoft Consulting Limited (if different) are not responsible for network, telephone line or communication failures of any kind or for entries that are incomplete or incomprehensible or not received. Such entries will be void. The Promoter reserves the right to verify the eligibility of entrants and check their identity. Entries that are incorrect, incomplete or inaudible will be void. No refund will be made for the cost of any entry. In the event of any fault, mistake, misunderstanding or dispute concerning the operation of any part of the competition or the operation of the phone system, the decision of the Promoter shall be final. The Promoter and QSoft Consulting Limited (if different) can make no guarantee of telephone access to the competition. The Promoter and QSoft Consulting Limited (if different) are not responsible for network, telephone line or communication failures of any kind or for entries that are incomplete or incomprehensible or not received. Such entries will be void. Nothing in these Terms and Conditions shall exclude or limit the Promoter's or QSoft Consulting Limited's liability for death or personal injury caused by their staff or supplier's negligence or for fraud. These Terms and Conditions shall be exclusively governed by and construed in accordance with the laws of England unless you as an entrant are a Scottish resident in which case you may choose the law of your residence and you irrevocably submit to the exclusive jurisdiction of the courts of England and Wales again unless you are a Scottish resident in which case you may choose the courts of your residence in Scotland. Please note that calls may be recorded to ensure that competition entries are captured, for staff training and quality control purposes.
